These Terms of Service (“Terms,” “Agreement”) form a legally binding contract between Dormate (“Dormate,” “we,” “our,” “us”) and you (“you,” “user,” “customer,” “purchaser,” “visitor”). By accessing or using any part of our website, services, products, or content (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be fully bound by these Terms. If you do not agree, you must stop using the Services immediately.
We intentionally made this long because people skim everything.
By using the Services, you:
Confirm you are at least 18 years old, or using the Services with parental/guardian consent.
Agree that these Terms constitute a binding contract.
Agree to follow all applicable local, state, federal, and international laws.
Agree that Dormate may update or modify these Terms at any time.
If material changes are made, we will update the “Last Updated” date and/or provide reasonable notice (for example, via a website banner). Your continued use after any update constitutes acceptance.
You are responsible for reviewing these Terms regularly.
You agree not to:
Misuse, hack, or interfere with the Services.
Use the Services for illegal, fraudulent, or harmful purposes.
Attempt to bypass security features or technical restrictions.
Copy, redistribute, or extract Content (defined below) without written permission.

Dormate may refuse service, cancel orders, or suspend accounts at our sole discretion, provided such actions are not discriminatory or unlawful.

Dormate does not guarantee:
Color accuracy on all screens
Error-free descriptions
Continuous availability of any product
Perfect accuracy of inventory levels
That products meet every personal expectation

Prices may change without notice.
Dormate is not responsible for:
Pricing or display errors
Third-party coupon issues
Banking fees or currency conversions
We may cancel any order involving:
Technical or human pricing errors
Suspicious or unverifiable payment information
Fraud prevention concerns
All payments must be authorized before order processing.
If an order is cancelled, your payment will be refunded to the original method. We are not responsible for bank-related fees.
Submitting an order does not guarantee acceptance. We may cancel orders for reasons including:

Shipping restrictions
Fraud prevention flags
If we cancel an order, you will receive a refund to the original payment method (excluding banking fees).
Shipping timelines are estimates, not guarantees.
In compliance with U.S. consumer protection law:
Risk of loss transfers to the customer when the package is delivered by the carrier, unless the customer selected their own shipping carrier.
Dormate is not liable for delays caused by carriers, weather, customs, or events outside our control.
Once a package is marked “Delivered” by the carrier, Dormate is not responsible for theft, misdelivery, or missing packages.
Incorrect address entries by the customer void Dormate’s obligation to replace or refund an order.
Shipping policies are governed by our separate Shipping Policy, incorporated by reference.
All returns and refunds follow our posted Return Policy.
Before purchasing, you are responsible for reviewing it.

If you create an account:
You must protect your login credentials.
You are responsible for all activity on your account.
Dormate is not liable for unauthorized access resulting from your negligence.
You must notify us immediately of suspicious activity.
We may suspend or delete accounts for violations of these Terms.
The Services may include third-party links or integrations. Dormate is not responsible for:
Third-party content, policies, or actions
Privacy or security practices of external websites
Losses resulting from your use of third-party services
You access external sites at your own risk.
To the maximum extent permitted by law, Dormate provides the Services “as is” and “as available.”
We disclaim all express and implied warranties, including:
Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability
Continuous availability
However, some states do not allow limitations on implied warranties, so these exclusions may not apply to you.
Nothing in these Terms limits warranties that cannot legally be disclaimed.
To the fullest extent permitted by law, Dormate is not liable for:
Direct, indirect, incidental, or consequential damages
Lost profits or revenue
Loss of data
Product misuse
Delivery delays
Unauthorized account access
Third-party actions
Our total liability for any claim shall not exceed the amount you paid for the product(s) involved, except where prohibited by law.
Nothing in these Terms excludes liability for:
Fraud
Intentional misconduct
Gross negligence
Violations of applicable law
You agree to indemnify and hold harmless Dormate, its owners, employees, partners, and suppliers from claims, damages, or expenses (including attorney fees) arising out of:
Your misuse of the Services
Your violation of these Terms
Your infringement of any third-party rights
Your violation of law
This survives account termination.
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and store information.
Dormate may terminate or restrict access to the Services at any time, with or without cause, and with or without notice, provided such termination is not discriminatory or unlawful.
Upon termination:
You must stop using the Services.
All sections intended to survive termination (including IP, indemnification, and liability limitations) remain in effect.
You agree that any dispute with Dormate will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
You waive the right to:
A jury trial
Participating in class actions or collective lawsuits
Claims must be brought on an individual basis.
Opt-Out:

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
If any portion of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.
These Terms constitute the entire agreement between Dormate and the user regarding the Services and supersede all prior agreements.
